Social Performance on Immigrants’ Cultural Rights, 2020~2022
Project description
The [Unfortunately only Korean nationals] project is a social performance and social art project by Artist Park Kyong Ju that contains attempts and processes to promote migrants’ cultural rights. Through her social art project [Unfortunately only Korean nationals], Park Kyong Ju tried to solve the improvement of cultural art policy and the change of perception for migrant artists in a new art language.
It has been more than 30 years since immigrants entered Korea, and there are 2.5 million foreigners residing in Korea, accounting for 5% of the total population of Korea. In particular, the reality is that even the correct residency qualifications and culture and art support policies to guarantee identity as artists are not properly prepared.
This social performance project [Unfortunately only Korean nationals] was planned by Park Kyong Ju to establish a system in which migrant cultural artists can continue artistic activities by being guaranteed independent (freelance) status of residence according to the specificity of the cultural arts field and to protect their human rights.
Agents, managers, production companies, advertising agencies, large corporations, and national and public institutions in the Korean arts and cultural industry all benefit from migrant artists, and the Korean government collects all of them as taxes. However, there is a lack of a public window that migrant artists can legally lean on. It is very embarrassing and regrettable that Korean society still maintains its firm stance of protecting only Korean citizens. For Korea to raise its national status and leap forward as a culturally advanced country, the rights protection and equal treatment of domestically active migrant artists must be addressed first.
The detailed goals of the project
1. Securing a social position for institutional improvement by becoming a non-standing member of the Arts Council Korea. This project will be carried out during the term of a non-standing member of Arts Council Korea. In other words, the project ends when the term of office ends.
2. A social performance that reflects the voices of migrant artists as much as possible in all processes of the project and supports them to voice themselves. In particular, rather than migrant worker activists from migrant labor backgrounds already known to the public, artist Park Kyong Ju discover various foreign artists and art college students in the fields of fine arts, performing arts, and entertainment who have not been able to voice. This project supports them to speak out for themselves and allows their diverse needs to be conveyed to Korean society. Through this, it arouses social interest in the ‘cultural rights of migrants’ that has not been noticed so far.
3. Demand to prepare a new residence system so that migrant artists can continue their artistic activities in an independent position (freelance) in line with the specificity of the field of culture and art.
4. Request for migrant artists to be qualified to apply for the National Culture and Arts Fund
5. Demand to prepare a plan for granting appropriate residence status to foreign students who majored in the field of culture and arts at domestic universities
6. As a legal protection window for the protection and prevention of the human rights of migrant artists, we urge that migrant artists be treated equally with Korean artists under the Artists Welfare Act, the Framework Act on Culture, and the Human Rights of Artists Act.
7. Demand for a fact-finding survey of migrants staying in the field of culture and arts to investigate the actual conditions and needs of migrant cultural artists to establish immigration and cultural arts policies that reflect the necessity of reality
How the project is executed
Various social performances, such as solidarity activities and workshops with migrant artists, social open discussions, Press release writing and press conference, public complaints to the government and policy proposals, write the ‘ Report of Immigrants Cultural Rights’ and submitted it to the UN Human Rights Council, and submit project proposals with the meaning of resistance to private organizations and groups
[아쉽게도 한국 국적자만] 프로젝트 소개
[아쉽게도 한국 국적자만 Unfortunately only Korean nationals] 프로젝트는 이주민의 문화권 증진을 위한 시도와 과정을 담은 박경주 작가의 소셜 퍼포먼스이자 소셜 아트 프로젝트이다. 박경주는 사회적 예술 프로젝트 [아쉽게도 한국 국적자만 Unfortunately only Korean nationals]을 통해 문화예술정책의 개선과 이주예술가에 대한 인식의 변화를 새로운 예술언어로 풀어내고자 하였다.
대한민국에 이주민이 입국한지 30년이 넘었고, 국내에 체류 중인 외국인이 250만명으로 대한민국 총 인구의 5%에 달하고 있지만, 한국 정부의 문화예술정책에는 이주민 예술가를 위한 정책이 없다. 특히 예술가로서 정체성을 보장할 올바른 체류자격과 문화예술지원정책 조차 제대로 마련되지 못하고 있는 것이 현실이다. [아쉽게도 한국 국적자만] 프로젝트는 문화예술분야의 특수성에 맞춰 이주민 문화예술인들이 독자적인 지위(프리랜서)의 체류자격을 보장받아 예술활동을 지속할 수 있는 제도와 이들의 인권보호 및 예방을 위한 법적 보호창구 마련을 촉구하고자 하는 취지의 박경주 작가의 사회적 퍼포먼스 프로젝트이다.
한국 문화예술 산업 내 국공립 기관은 물론 에이전트, 매니저, 제작사, 광고 대행사, 대기업은 모두 외국인 이주민 예술가들에게서 이익을 얻고 있고, 한국 정부는 이를 모두 세금으로 징수하지만, 이들이 합법적으로 기댈 수 있는 공적인 창구가 부족하다. 한국 사회는 여전히 한국인 국적자만 보호하겠다는 단호한 입장을 고수하고 있는 것은 매우 부끄럽고 아쉽다. 대한민국이 국가위상을 높이고 문화 선진국으로 도약하기 위해서는 국내 활동 이주민 예술가의 권리보호와 동등한 처우가 우선적으로 해결되어야 한다.
프로젝트의 세부 목표
1. ‘한국문화예술위원회 비상임 위원 되기’를 통해 제도 개선을 위한 사회적 위치 확보. 본 프로젝트는 한국문화예술위원회 비상임위원 임기 기간 동안 진행됨. 즉 임기가 끝나면 프로젝트도 종료됨.
2. 프로젝트의 모든 과정에서 이주민 예술인 당사자들의 목소리를 최대한 반영하고 스스로 목소리를 낼 수 있도록 지원하는 소셜 퍼포먼스 진행. 특히 이미 대중에게 알려진 이주노동 배경의 이주노동자 활동가가 아니라, 그동안 음지에서 고통받으며 목소리를 내지 못해온 순수예술, 공연예술, 엔터테인먼트 분야의 외국 국적 예술인들과 예술대학유학생들을 발굴하여 이들의 스스로 목소리를 내, 다양한 요구가 한국 사회에 전달될 수 있도록 함. 이를 통해 그동안 주목받지 못한 ‘이주민의 문화적 권리’에 대한 사회적 관심을 불러 일으키도록 함.
3.문화예술분야의 특수성에 맞춰 이주민 예술가들이 독자적인 지위(프리랜서)에서도 예술활동을 지속할 수 있도록 체류제도를 마련할 것을 요구
4.이주민 예술인의 국가문화예술 기금 지원자격 부여 요구
5.국내 대학에서 문화예술분야를 전공한 유학생을 위한 적절한 체류자격 부여방안 마련 촉구
6.이주민 예술인의 인권보호 및 예방을 위한 법적 보호창구로써 한국인 예술가와 동등하게 예술인복지법, 문화기본법, 예술인권리보장법에서 이주민 예술가를 동등하게 대우할 것을 촉구
7.현실의 필요성을 반영한 이민·문화예술 정책을 수립하기 위해 이주민 문화예술인 실태 및 요구 조사하기 위한 문화예술분야 체류 이주민 실태조사 촉구.
프로젝트 실행 방법
이주민 예술가들과의 워크숍, 사회적 공개토론, 보도자료 작성 및 기자회견, 정부에 대한 공개민원제기 및 정책제안, 국립현대미술관 사루비아다방 등 민간기관 및 단체에 저항적 의미의 프로젝트 제안서 발송, ‘이주민의 문화권보고서’ 작성 및 유엔인권이사회 제출 등 다양한 사회적 퍼포먼스 진행

Social discussions and policy improvement are needed from the perspective of cultural diversity so that migrant artists can be guaranteed opportunities to work stably in Korean society.

In relation to the 2023 Arts Council Korea competition qualifications, discussions were held on plans to expand and ease the application qualifications to all foreign artists residing in Korea. The committee had in-depth discussions on various types of visas for migrant artists and whether or not to grant qualifications for application for competition, but it was rejected. About the 2023 Korean Culture and Arts Council support project application qualifications, we discussed expanding and mitigating the application qualifications to all foreign artists residing in Korea. The committee decides that it is desirable to expand the application through the process of listening to and sharing the opinions of direct stakeholders in the future, so the decision is withheld.
